Mini-rules

*NO PURCHASE NECESSARY. Contest starts on November 1, 2016 at 9:00:01 a.m. Eastern Time (“ET”) and ends 11:59:59 p.m. ET on December 31, 2016 (the “Contest Period”). Open to National Bank of Canada Mastercard cardholders who are legal residents of Canada and have reached the age of majority or older in their province/territory of residence at the time of entry. Automatically receive one (1) entry for each eligible National Bank of Canada Mastercard card purchase made during the Contest Period. One (1) Grand Prize available to be won, consisting of $5,000 in Mastercard prepaid cards for the Grand Prize winner and $5,000 in Mastercard prepaid cards for another person of his/her choosing. Both must be residents of Canada and be over the age of majority in their province/territory of residence. Total retail value of the Grand Prize is $10,000 CDN. Grand Prize winner will be selected by random draw on January 16, 2017. Winner must correctly answer a mathematical skill-testing question. Full rules (the “Contest Rulesʼʼ):

1. ELIGIBILITY:

The National Bank of Canada Mastercard® Holiday Contest (the “Contest”) is open to National Bank of Canada Mastercard cardholders who are residents of Canada and are of the age of majority or older in their province/territory of residence at the time of entry. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Mastercard Canada ULC (the “Sponsor”), Armstrong Partnership LP (the “Administrator”), National Bank of Canada, and each of their respective parent companies, related companies, affiliates, distributors and subsidiaries and advertising/promotion agencies (collectively, the “Contest Parties”) are not eligible to participate in the Contest. This Contest is subject to all applicable federal, provincial and local laws and regulations.

The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. 

2. HOW TO ENTER:

i) Automatically receive one (1) Contest entry for each eligible National Bank of Canada Mastercard card purchase (“Eligible Transaction”) made between November 1, 2016 at 9:00:01 a.m. Eastern Time (“ET”) and December 31, 2016 at 11:59:59 p.m. ET (the “Contest Period”). All transactions, including online transactions, are eligible. Entries resulting from unauthorized Mastercard card use or made with lost, stolen or fraudulent Mastercard cards do not count as Eligible Transactions and are void. Account adjustment transactions/returns and other fees assessed to your Mastercard account are not considered Eligible Transactions for automatic entry. The winning account must be in good standing and not otherwise have privileges suspended at the time of entry, winner selection and/or awarding of the Grand Prize. Only purchases made with a Mastercard card that is in good standing (at time of entry, winner selection and awarding of the Grand Prize) and issued to an identifiable end user and purchases that are processed and submitted through the U.S. transaction processing system of Mastercard International Incorporated during the Promotion Period are Eligible Transactions for automatic entry.

Opt Out: If an eligible National Bank of Canada Mastercard cardholder does not wish to be entered into this Contest, they may opt out from participation by calling 1-866-225-8565 during the Contest Period.

AND/OR

ii) No Purchase Necessary: To enter without purchase, hand-print your name, as it appears on your National Bank of Canada Mastercard card, your complete mailing address (including postal code), telephone number, and age on a plain piece of paper along with a 50 word essay explaining why you would like to win the Grand Prize and mail it in a sealed postage pre-paid envelope to: National Bank of Canada Mastercard Holiday Contest, No Purchase Entry, c/o Armstrong Partnership LP, 23 Prince Andrew Place, Toronto, Ontario M3C 2H2. Each mail-in entry will result in one (1) entry in the random prize draw. Enter as often as you wish by mail, but each entry must: (i) be mailed in a separate sealed envelope with sufficient postage; and (ii) postmarked no later than December 31, 2016, and received no later than January 6, 2017. Incomplete and/or illegible entries are ineligible. No photocopied, computer-generated facsimiles, mechanically reproduced, bulk or mass entries permitted.

There is no limit to the number of entries. All entries, regardless of the method of entry, become the property of Sponsor and will not be acknowledged or returned. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries, Eligible Transactions and/or entrants. The Released Parties (defined below) are not responsible for lost, incomplete, illegible, late, misdirected, stolen, postage-due or mutilated entries or mail; any error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines or telephone systems; interrupted or unavailable cable or satellite systems; errors in these Rules, in any Contest-related advertisements or other materials; failures of electronic equipment, computer hardware or software, or inaccurate entry information, whether caused by equipment, programming used in this Contest, human processing error or otherwise. Sponsor reserves the right, at its sole discretion, and in Québec, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”), to disqualify any entry, to modify, terminate or suspend this Contest (or amend these Rules) should a virus, bug, non-authorized human intervention, action of entrant(s) or other cause corrupt or impair the administration, security, fairness or proper play of the Contest, and, if the Contest is modified, terminated or suspended, select at random a winner from those eligible, non-suspect entries received prior to the event requiring such modification, termination or suspension. The Sponsor reserves the right, and in Québec, subject to the approval of the Régie, to cancel or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.

All entries (and Eligible Transactions) are subject to verification at any time. The Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Sponsor’s official clock.

3. GRAND PRIZE:

There is one (1) Grand Prize available to be won, consisting of $5,000 CDN in Mastercard prepaid cards for the Grand Prize winner and $5,000 CDN in Mastercard prepaid cards for another person of his/her choosing. Both must be residents of Canada and be over the age of majority in their province/territory of residence as of December 31, 2016. Total approximate retail value of the Grand Prize is $10,000 CDN. Grand Prize must be accepted as awarded. Any costs associated with claiming the prize that are not specifically stated herein are the responsibility of the Grand Prize Winner.

4. WINNER SELECTION AND NOTIFICATION:

On January 16, 2017 (the “Draw Date”), at approximately 1:00 p.m. at Armstrong Partnership LP, 23 Prince Andrew Place in Toronto, Ontario, one (1) eligible entrant will be selected by random draw as the potential Grand Prize winner. Odds of winning depend on the number of eligible entries received in accordance with these Rules and the number of eligible entries received by each entrant. 

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the selected entrant by mail, telephone or email within ten (10) business days of the Draw Date. If the selected entrant cannot be contacted within ten (10) business days of the Draw Date, or there is a return of any notification as undeliverable; then he/she will be disqualified (and forfeit all rights to his/her prize) and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new selected entrant). For greater certainty and the avoidance of any doubt, the Sponsor does not have the obligation to select an alternate eligible winner.

5. WINNER CONFIRMATION:

Prior to being declared the confirmed winner of the Grand Prize, the eligible winner will be required to: (i) correctly answer a time-limited, mathematical, skill-testing question (without electronic, mechanical or other assistance); and (ii) sign and submit the Sponsor’s declaration and release, which (among other things): (a) confirms compliance with these Rules; (b) acknowledges acceptance of the prize as awarded; and (c) releases the Contest Parties, and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the prize. If the eligible winner: (a) fails to correctly answer the skill-testing question; (b) fails to submit the properly executed Contest documents; and/or (c) cannot accept a prize for any reason, then he/she will be disqualified (and will forfeit all rights to the Grand Prize), and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant.

6. PRIVACY:

Your use of your Mastercard card to make a purchase during the Contest Period and/or your submission of a mail-in entry constitutes your consent to participate in this Contest and your consent for Sponsor and Administrator to obtain, use, and transfer your name, card number, email and mail, phone number, age and other information for the purpose of administering this Sweeps, awarding the Grand Prize, to comply with legal requirements and in accordance with the Sponsor’s Privacy Notice accessible at www.mastercard.ca/privacy. For automatic entries, Sponsor (or Administrator on Sponsor’s behalf) may obtain the account holder’s personal contact information (name, email address, phone number) from National Bank of Canada in order to award the Grand Prize. 

Except where prohibited by law, acceptance of a prize constitutes winner's consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or city/province of residence for advertising and promotional purposes in any media, worldwide, without payment or consideration. You may be required to sign a document confirming your consent to this effect.

Your personal information may be stored on servers located in the United States and therefore subject to the laws of the U.S. and/or other jurisdictions.

7. GENERAL:

The decisions of the Sponsor (and/or Representative, as applicable) with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or entrants, and are in Québec subject to the approval of the Régie. By participating in this Contest, you are giving consent to the Sponsor to obtain and deliver your name, address, and other information to the Contest administrators only for the purpose of administering this Contest. Sponsor and/or its agents may obtain personally identifiable information about you only in the event that you are a winner in accordance with these Rules. The Released Parties are not responsible for: (i) any error, omission, interruption, defect or delay in transmission or communication; (ii) technical or mechanical malfunctions; (iii) errors in these Rules, or in any Contest-related advertisements or other materials; and (iv) failures of electronic equipment, computer hardware or software, or inaccurate capture of information, whether caused by equipment, programming used in this Contest, human processing error, or otherwise. 

The Sponsor reserves the right, at its sole and absolute discretion, and in Québec subject to the approval of the Régie, to disqualify any entrant, and to modify, terminate or suspend this Contest (or amend these Rules) for any reason, including, without limitation, should a virus, bug, non-authorized human intervention, action of entrant(s), or other cause corrupt or impair the administration, security, fairness or proper play of the Contest. For Québec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

By participating in this Contest, each entrant: (i) agrees to be legally bound by these Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action; and (iii) releases the Released Parties from any and all liability in connection with this Contest and his/her participation therein. 

The Released Parties shall have no liability and will be held harmless for any liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this Contest.

All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates and/or the National Bank of Canada. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to any point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
