Governing legislation

If you have accessed our financial products and services through our Internet Banking Solutions, these Terms of Use apply concurrently to the specific agreements and rules that govern those products and services. In the event that these Terms of Use are incompatible with the applicable specific and agreements and rules, the latter shall prevail.

Internet Banking Solutions

When you carry out transactions with us through our Internet Banking Solutions, you alone are responsible for ensuring that all user codes, access card numbers, passwords, and personal identification questions used on the Site are protected. We shall not be held responsible for any damages that you may incur as a result of the unauthorized or illegal use of the user code(s), access card number(s), password(s), or personal identification question(s), or your failure to ensure the secure and confidential nature of the transactions.

When using our Mobile Banking Solutions, it is possible that you may not have access to the entirety of the features, functions, content or information related to our products and services, and that they may not be accessible outside of Canada. Any fees charged by your service provider for the use of our Mobile Banking Solutions are your sole responsibility. We can collect, using cookies and other information-gathering technologies, information on your online activity to evaluate the effectiveness of our online promotions and to collect data on the functioning of the Site in order to: enhance our understanding of your needs and interests; offer you a personalized online experience; and provide you with information on our products and services that may be of interest to you. We may make software available for you to download that allows you to use our Mobile Banking Solutions. We reserve at all times our intellectual property rights in this software. You may not copy such software in whole or in part, or make it accessible to third parties. Confidentiality and security

We comply with the applicable law governing the protection of personal information. In addition, we use the latest encryption techniques to guarantee the confidentiality of the information exchanged with you through Internet Banking Solutions and Mobile Banking Solutions. We cannot, however, protect information exchanged when the Website is accessed through a non-secure platform or in a public location, which could endanger the confidentiality of your personal information. E-mail communications are neither secure nor confidential. They can be lost or intercepted, in much the same way as communications by other means (for example, by post).
